
On March 9, 2010, significant amendments were published that narrows the list of materials subject to the Security Plan requirements. However, for those companies who are still subject to the requirements, new elements must be addressed in your plan related to risk assessment, planning, training, and documentation. The Final Rule becomes effective on October 1, 2010. Please carefully read the brochure and the Order Form/Worksheet before completing the documents and submitting your order. PERS has developed a new Security Plan Compliance Package intended for companies who offer or transport propane/lpg, gasoline, ethanol, gasoline and ethanol mixtures, other class 3 flammable liquids in packing group II, anhydrous ammonia, oxygen, and/or ammonium nitrate or ammonium nitrate fertilizer. If you offer/transport one or more of these hazardous materials in a "large bulk quantity", you remain subject to the security plan requirements.
For the purpose of the new security plan regulations, a large bulk quantity is defined as a quantity greater than 792 gallons for liquids and gases (or 6,614 pounds for solids) in a single packaging such as a cargo tank motor vehicle, portable tank, tank car, or other bulk container.
